The Court of Instruction Number 2 of San Bartolomé de Tirajana, in southern Gran Canaria, has forwarded the prosecution's indictment, which requests a four-year prison sentence for EBR, a Paraguayan national accused of sexually assaulting a minor under 16 years of age. The events, which occurred in the municipality of Santa Lucía de Tirajana, will be tried soon in the Provincial Court of Las Palmas.
According to the Public Prosecutor's account, the incident took place at approximately 10:15 a.m. on May 16, 2025. The accused was at his home with the victim, a 15-year-old girl who was in a relationship with his son. Taking advantage of this relationship of trust and family closeness, the man invited the young woman to sleep with him, at which point he allegedly took the opportunity to touch her breasts with the intent to violate her sexual integrity.
For these acts, the Public Prosecutor's Office classifies what happened as a crime of sexual assault against a minor under 16 years of age, as defined in Article 181.1 of the Penal Code. In addition to a prison sentence, the Public Prosecutor requests that the accused be placed on supervised release for six years after his release from prison, as well as being barred from any profession or activity that involves direct contact with minors for a period of ten years.
The sentencing request also includes strict protective measures for the victim. The prosecutor is seeking a restraining order prohibiting the accused from approaching within 200 meters of the minor, her home, or her school, as well as a ban on communicating with her by any means for six years. In terms of civil liability, the prosecution is requesting €3.000 in compensation for the young woman for the emotional distress caused.
The indictment calls for the application of Article 89.1 of the Penal Code, requesting EBR's expulsion from the country once he has served two-thirds of his sentence, with an express prohibition on returning to Spain for a period of six years. The trial is now pending scheduling at the Provincial Court to determine the defendant's criminal liability.
