A shocking incident in southeastern Gran Canaria with a five-year-old boy as the victim

The tranquility of Avenida de Canarias, Santa Lucía de Tirajana, was shattered on the afternoon of February 28, 2024. According to the Public Prosecutor's account, the events occurred around 20:30 p.m. inside the Bar C'Andres establishment. 

The case, which is now heading towards the opening of oral proceedings before the Provincial Court, reveals that the accused is no stranger to the courts, as he has a previous conviction for a breach of a restraining order issued at the end of 2020 by a court in Telde. 

At that location, the accused, identified as FSA, allegedly touched the genitals of a child just five years old. The indictment, to which Maspalomas24H has had access, details that the defendant acted knowingly, violating the child's sexual freedom, and repeated the action even after the child tried to remove his hand, only stopping when a witness intervened to pull the child away.

Regarding reparations, the minor's legal representative is seeking compensation for the emotional distress suffered. The prosecution has set this amount at €1.000, which the defendant must pay to the minor for the psychological impact resulting from the inappropriate touching he endured in that bar in the south of the island.

Given the seriousness of the events, the Public Prosecutor's Office has classified the acts as a crime of sexual assault against a minor under 16 years of age and is requesting a sentence of two years and six months in prison for the accused. In addition to imprisonment, the Public Prosecutor's Office is seeking a six-year period of supervised release for FSA after his release from prison, as well as disqualification from any profession that involves contact with minors. 

Control over the accused would be further secured by a restraining order prohibiting him from approaching within 500 meters of the victim or communicating with him for a period exceeding his prison sentence by six years. When the child turns 12, he will still be just that: a defenseless child.
