Man arrested for sexually assaulting a young woman with cerebral palsy in southeastern Gran Canaria

The First Section of the Provincial Court of Las Palmas is preparing to try one of the most serious cases of sexual assault recorded in southeastern Gran Canaria in recent years. The Public Prosecutor's Office has filed its indictment against JMN de P., for whom it is requesting a fifteen-year prison sentence for repeated sexual assault against his partner's daughter, a young woman with cerebral palsy and a 98 percent physical disability.

According to the Public Prosecutor's account, which Maspalomas24H has obtained, the events took place at the family home in Santa Lucía de Tirajana during the lockdown and confinement period resulting from the health crisis, between March and August 2020. The accused allegedly took advantage of the victim's extreme vulnerability—she is completely dependent for all activities of daily living and lacks the capacity to act in legal or financial matters—to subject her to constant abuse. The Prosecutor's Office details an escalation of assaults that included groping, vaginal penetration, and oral assault in which the defendant used force to overcome the young woman's resistance.

The legal assessment is based on the recent reform of Organic Law 10/2022, known as the Comprehensive Guarantee of Sexual Freedom Act, considering that the acts were carried out without the consent of a person whose capacity for self-determination is nullified by their underlying medical condition. The seriousness of the accusations is heightened by the familial relationship and the victim's particular vulnerability due to their disability, factors that raise the prosecution's request to the upper range of penalties stipulated in the Criminal Code.

In addition to the prison sentence, the prosecution is seeking a ten-year period of supervised release following his release from prison, as well as a ten-year restraining order prohibiting him from approaching or communicating with the victim by any means. The defendant, who is currently barred from leaving the island of Gran Canaria and has no passport by court order, also faces a special disqualification from any profession or public office that involves contact with minors or people with disabilities.
