The Public Prosecutor's Office has requested the opening of oral proceedings before the Provincial Court of Las Palmas against a man accused of sexually abusing his underage stepsister in San Bartolomé de Tirajana during the summer of 2022. The document, sent to the Court of Instruction No. 2 of San Bartolomé de Tirajana within the framework of an abbreviated procedure, attributes to the defendant —identified as SMO, of legal age and with no prior record— the alleged commission of a continuous crime of sexual abuse of a minor under 16 years of age and a minor crime of threats.
According to the Public Prosecutor's Office, the events allegedly took place between the first half of July and the first half of August 2022 at the home of the paternal grandparents, in Castillo del Romeral, where the accused lived with the minor during the periods in which she stayed with her father.
The prosecution maintains that, during that period, the suspect allegedly touched the minor's breasts and buttocks over her clothing on several occasions for sexual purposes. It also includes an incident in which, after being reprimanded by the minor, he allegedly intimidated her by raising his fist and making threatening remarks.
For these acts, the prosecutor is seeking a six-year prison sentence, in addition to disqualification from any profession or occupation involving contact with minors for eleven years. The prosecutor is also requesting a restraining order prohibiting the defendant from approaching or communicating with the victim for twelve years. Regarding the minor offense of threats, the prosecutor is requesting a fine of four months at a daily rate of 15 euros, as well as an additional six-month restraining order. The indictment also includes a request for ten years of supervised release and payment of court costs.
Regarding civil liability, the prosecution is requesting that the defendant compensate the minor with 6.000 euros, plus applicable legal interest. The case is pending a decision from the court regarding the commencement of oral proceedings and its subsequent scheduling at the Provincial Court.
