The Las Palmas Public Prosecutor's Office has requested a 12-year prison sentence for AEFA, accused of homicide following a brutal attack at the Europa Shopping Center in Puerto Rico (Mogán). The events, which will be tried by a jury, date back to the early morning of July 16, 2023, when an argument fueled by alcohol and drugs ended with the death of a man after he was repeatedly kicked in the head while on the ground.

According to the indictment, the defendant and the victim were in a dividing corridor of the entertainment area consuming alcoholic beverages and cocaine. After an initial argument, the defendant shoved the victim hard and, minutes later, knocked him to the ground with a punch to the face. It was at that moment, with the man defenseless on the ground, that the defendant kicked him repeatedly in the head. The prosecution maintains that the assailant acted knowing that these blows could cause death, accepting that possibility.

The severity of his injuries necessitated the immediate transfer of the victim, first to the Arguineguín Health Center and then to the Insular Hospital, where he was admitted in a coma. The diagnosis revealed a severe traumatic brain injury with intracranial hemorrhage, requiring an emergency decompressive craniectomy. Despite the medical efforts in the Intensive Care Unit, the man died on July 28, 2023, twelve days after the attack.

The accused, who has been in pretrial detention since August 2023, has a criminal record, although this is not considered for the purposes of recidivism in this case. It is worth noting that, at the time of the incident, the defendant was serving a suspended sentence for a previous restraining order offense handed down just two months prior in a court specializing in violence against women.

In addition to the 12-year prison sentence, the Public Prosecutor's Office is seeking a total of €200.000 in compensation for the deceased's family. The breakdown includes €50.000 for each of the parents and €20.000 for each of the five siblings. As this is a jury trial, ordinary citizens will determine the defendant's guilt by analyzing whether there was intent to kill or if the death was an accepted consequence of the violence of the blows.
