The legal report halts the municipalization of advertising in Maspalomas

The first deputy mayor of San Bartolomé de Tirajana, Alejandro Marichal, has indicated, following a recently published legal report, that the municipalization of public services must be addressed within the limits established by the regulations.

 

The councilman asserts that municipalization “cannot be based on political will alone” and warns of “significant legal obstacles” in areas such as urban advertising if the model is not adapted to current legislation. “In other words, it simply cannot be done this way.”

 

Marichal recalls that the urban advertising service is based on an administrative concession granted in 1994, whose contract has been expired since 2012, generating a complex legal scenario after years without a definitive solution.

 

Since the current administration took office in 2023, the Urban Planning Department has been reviewing the file to regularize the situation, analyzing different alternatives and gathering technical reports. Initially, the possibility of municipalizing the service was considered, but legal reports conclude that this option is not viable, so the tender process will proceed in accordance with current regulations.

 

“In this case, it was a matter of taking on six workers and providing a basic service, and even so, the reports make it unfeasible,” explains Marichal, who emphasizes that “this demonstrates that municipalizing a service is not as simple a matter as other groups suggest.” 

 

The councilman warns that this reality is even more evident in services like sunbeds and umbrellas, which are more complex and involve a larger volume of activity. “Those proposing municipalization must explain how they intend to do so without running into the same legal problems,” he points out.

 

He also insists that governing is not about generating headlines, but about making decisions with legal certainty, avoiding legal conflicts and defending the interests of the City Council.
