Man arrested for sexually assaulting his minor daughter's friend in southern Gran Canaria

The Public Prosecutor's Office has requested that AMR, a Cuban national and of legal age, be brought to trial for the alleged sexual assault of a 16-year-old girl in the early hours of May 6, 2023, at a residence in southern Gran Canaria. The case, as confirmed by Maspalomas24H, is being handled by the Court of Instruction No. 3 of San Bartolomé de Tirajana, and the Public Prosecutor's Office is requesting that the proceedings be transferred to the appropriate section of the Provincial Court for the trial.

According to the indictment, the accused placed a mattress next to the bed where his daughter was sleeping with her friend, identified as SDR (born in 2008). He positioned himself behind the girl and rubbed his penis against her, placing it between her legs without penetrating her. Subsequently, according to the prosecution, he knelt down and masturbated while touching the girl's leg. She then went to the bathroom and refused the accused's request for a kiss.

The complaint was filed by the mother and legal representative of the minor with the National Police of Maspalomas on May 6, 2023. The psychological expert report submitted to the summary concludes that the victim presents emotional, cognitive and social sequelae compatible with a post-traumatic stress disorder with dissociative symptoms linked to the events investigated.

The prosecution considers the events to constitute a crime of sexual assault against a minor under 16 years of age, as defined in Article 181.1 of the Criminal Code, and accuses AMR as the perpetrator under Articles 27 and 28 of the same legal text. It finds no mitigating or aggravating circumstances.

As punishment, the prosecution is requesting a four-year prison sentence, special disqualification from holding public office during the term of the sentence, and four years of supervised release after the sentence is served, with the obligation to report any change of residence or employment. It is also requesting a six-year disqualification from parental rights and an eight-year disqualification from holding any employment or profession. Furthermore, a restraining order prohibiting the defendant from approaching or communicating with the victim for a period of four years is being sought. In the civil case, the Public Prosecutor's Office is seeking €18.000 in compensation for the victim, plus applicable legal interest.
