Trial for brutal beating of a driver in southern Gran Canaria

The Las Palmas Provincial Prosecutor's Office has requested a five-year prison sentence for a man accused of brutally assaulting his ex-partner inside a moving vehicle in southern Gran Canaria. The Public Prosecutor's provisional conclusions, submitted to the Court for Violence Against Women Number 1 of San Bartolomé de Tirajana, request that the case proceed to trial before the Provincial Court of Las Palmas against the defendant, C. d. JAC, for aggravated assault with the aggravating circumstance of kinship. The prosecution recounts an episode of extreme physical violence that resulted in the victim losing a tooth and suffering jaw fractures. The attack occurred in a busy tourist area of ​​the southern region.

The incident occurred in the early morning of December 9, 2023, on Avenida de la Unión Europea, the urban road connecting the town's residential areas with the GC-500 highway. The defendant was traveling in the passenger seat of the car driven by the victim, EAR, with whom he had been in a relationship for a year and a half, including several months of cohabitation. During a verbal argument, the defendant acted with the intent to harm the woman, repeatedly punching her in the face and violently shaking her while the vehicle was in motion, directly endangering road safety in the area.

The prosecution's account details that the victim attempted to repel the attack by pushing the assailant's face away, solely to defend herself and stop the blows, without any prior provocation on her part. The accused's reaction consisted of forcefully grabbing the driver's head, pushing it, and repeatedly slamming it against the driver's side windshield. Medical reports submitted to the court ruled out any criminal liability on the part of the woman, strictly determining that the minor injuries the man sustained after the altercation were caused exclusively by the legitimate exercise of self-defense in response to the severity of the attack.

The physical consequences of the trauma required emergency surgical and dental intervention. The forensic report confirms the loss of the upper left central incisor, deep lip erosion, severe hematomas in the left malar region, and erosions in the posterior cervical area. The injured party required specialized dental replacement treatment and repair of adjacent teeth damaged by the impacts, resulting in seven days of incapacity for her usual activities. The medicolegal report confirms a permanent consequence assessed in two points of aesthetic impairment resulting from the alteration of her oral and dental physiognomy.

The Public Prosecutor's legal classification places the events under Article 150 of the Penal Code, which pertains to injuries resulting in the loss or deformity of a non-essential organ or limb. In addition to a prison sentence, the prosecutor is requesting special disqualification from holding public office for the duration of the sentence and the imposition of a mandatory restraining order. The accused may not approach within 500 meters of EAR, his home, or his workplace in the south of the island, and any type of written, verbal, or electronic contact is prohibited for a period of seven years.

The civil liability claim requires the payment of a total compensation of €6.259,84 to the injured party, an amount that will accrue legal interest as established by the Civil Procedure Law. The breakdown of the compensation includes €433,23 for the days of moderate personal injury, €3.932,00 to cover the costs of repairing the aesthetic damage, and €1.894,61 as compensation for permanent physical injuries. The proceedings are nearing completion, with the Provincial Court chamber that will host the hearing in the coming months set to be designated.
