The Second Section of the Provincial Court of Las Palmas de Gran Canaria will try an Italian national, identified by the initials SC, for a series of violent assaults and abuses committed against his former partner in southern Gran Canaria. The prosecution's preliminary findings reveal an extremely serious criminal record, characterized by repeated acts of gender-based violence perpetrated by the accused despite multiple final judgments against him issued by courts on the island. The events under investigation took place within the judicial district of San Bartolomé de Tirajana, where the victim resided.

The ordeal of the woman, whose initials are RBdM, worsened dramatically during the early morning hours of September 29, 2024. According to the prosecution, the defendant used his mobile phone to send a series of text messages and audio recordings filled with degrading insults, contemptuous remarks, and explicit death threats, with the clear intention of terrorizing and humiliating her. The recordings included expressions such as "just wait until I get you, I'll punch you so hard your head will explode" and "I'm going to kill you," causing profound distress and anguish in the victim.

The escalating violence turned physical in the early hours of October 2, 2024, when SC demanded that the woman come to his home in the municipality of San Bartolomé de Tirajana. During a heated argument, the defendant grabbed her by the hair, threw her onto the mattress, and repeatedly slapped her. As a result of the physical abuse, the victim suffered facial contusions in the cheek area, nasal abrasions, jaw pain, and hematomas on her left thigh, requiring medical attention and ten days of recovery.

The physical assault escalated the following morning when the defendant subjected his ex-partner to an inspection of her private communications. After forcing her to show him the contents of her mobile phone, SC threatened her, warning her that she would receive a punch for every text message sent by any other man. Immediately afterward, he dragged the woman by the hair into the bedroom, saying, "Now we're going to fuck, no matter what," where he forcibly undressed her, immobilized her by forcing her legs open despite her active resistance, and vaginally penetrated her until he ejaculated, committing the crime of aggravated sexual assault.

The element that lends exceptional gravity to this case is the ineffectiveness of prior criminal proceedings in curbing the defendant's behavior. The public prosecutor formally invokes the mitigating circumstance of recidivism, based on four prior final judgments issued between 2018 and 2024 for crimes of assault and threats against women. Of particular note is a sentence handed down by the Telde Court on May 10, 2024, which imposed a six-month prison term, the execution of which was suspended for four years when he committed the new abuses. The aggressor has been held in pretrial detention without bail for these acts since October 7, 2024.

The prosecution's overall sentencing request for the trial amounts to 16 years of imprisonment in a penitentiary, divided into 14 years for the sexual assault with penetration of the partner, one year for the crime of threats, and another year for the crime of assault within the context of gender-based violence, plus an additional 30 days of house arrest for unjust harassment. The document also demands an absolute prohibition on communicating with or approaching the victim within 500 meters for a cumulative period of 28 years, eight years of subsequent supervised release, and a special disqualification from practicing any profession related to contact with minors for a period of 15 years.
