The Urban Planning Department of the San Bartolomé de Tirajana City Council has opened a preliminary public consultation for the drafting of the future Municipal Ordinance Regulating the Legal Framework for Residential Use in the Coastal Tourist Zone. Until September 4th, affected individuals, associations, and interested entities can submit their contributions to the regulation, which aims to provide greater clarity and legal certainty in the application of current regulations to residential use in the tourist zone.
With this initiative, the City Council aims to listen directly to those who have been living for years with the uncertainty stemming from the application of the Tourism Law. Before drafting the ordinance, the Department of Urban Planning wants to learn firsthand about the problems faced by those affected, what aspects they believe need clarification, what objectives the future regulation should pursue, and what alternatives they propose to improve the situation. The contributions received will serve as the basis for drafting the final text.
As First Deputy Mayor Alejandro Marichal explains, “Many people have been living for years with uncertainty about their housing situation and with the worry generated by the penalty proceedings. That is precisely why we are taking this step. We want to listen to them in order to draft the ordinance, because no one knows this reality better than those who live it every day.”
Marichal explains that the City Council's objective is not to modify the urban planning or create new rules, but rather to offer a tool that allows for a clear and consistent interpretation and application of current regulations. "What we want is to clarify how current regulations apply to the various situations that exist in the tourist area in order to offer greater legal certainty, both to residents and to the Administration itself."
For her part, the Councilor for Urban Planning, Davinia Ramírez , explains that the decision to process a municipal ordinance is the result of the technical work carried out over the last few months. "Initially, the possibility of acting through a modification of the planning regulations was studied, but the technical analysis concluded that it was not necessary to modify the General Plan. What is needed is a regulation that clarifies the application of current legislation and provides legal certainty while work continues on adapting the planning regulations."
Ramírez emphasizes that the future ordinance will not change the current urban planning rules, but will allow for the identification of the different situations existing in the tourist area and determine which regulations are applicable in each case, facilitating a homogeneous interpretation for both citizens and the Administration itself.
The public consultation will allow those affected to speak from their own experiences, defining the problems they have faced, clarifying any remaining doubts, and identifying which aspects should be better defined. These contributions will be fundamental in drafting a useful, understandable ordinance that is adapted to the realities faced by many families in the municipality.
