The prosecution has requested a three-year prison sentence for YEVG, accused of violently assaulting his niece's ex-partner during the Vecindario carnival celebrations. The indictment, submitted to the competent Criminal Court for the opening of the trial, charges him with assault for the blows and kicks inflicted on the victim in a public place.

The events occurred at approximately 00:50 on June 5, 2022. According to the Public Prosecutor's Office, the accused approached the victim, AJG, whom he knew through her past romantic relationship with his niece. Driven by the intent to harm her, the accused gave her a forceful shove that caused her to fall to the ground.

Once on solid ground, the assailant continued the attack, delivering several kicks to the victim's back and attempting to strike him directly in the face. The victim managed to raise his right hand to block the blow, preventing more serious facial injuries but causing severe wounds.

As a result of the attack, the woman suffered a displaced fracture of the fourth metacarpal bone in her right hand and various lacerations in her lower back and hand. The injuries required specialized medical treatment, including immobilization with a splint and subsequent rehabilitation. The victim required one day of hospitalization and was unable to perform her usual activities for 136 days. She was left with permanent disabilities, including one point for chronic pain and two points for disfigurement.

The prosecution classifies the events as a crime of assault under Article 147.1 of the Penal Code, attributing direct authorship to the defendant without any mitigating or aggravating circumstances. The accused, born in 1998 and with no prior criminal record, faces a three-year prison sentence, disqualification from holding public office for the duration of the sentence, and payment of court costs.

In the civil liability section, the public prosecution demands that YEVG compensate the victim with 14.162,63 euros for the days of incapacity, hospital admission and the aesthetic and functional sequelae resulting from the attack.
