The TSJC endorses the Canary Islands Ports scheme in southern Gran Canaria in the face of municipal litigation

The ruling states that, logically, all public administrations have the right to intervene in the proceedings, but not that their intervention is key to their future development. The High Court of Justice of the Canary Islands has endorsed the administrative framework of Puertos Canarios (Canary Islands Ports Authority) in the management of regional infrastructure, reaffirming the technical and legal criteria applied by the public body in processing the concession applications that form the backbone of the archipelago's coastline.

The doctrine established by the judicial bodies supports the autonomy of the public entity in the regulation of the enabling titles, prioritizing legal certainty, competitive competition and the rigorous compliance with the economic and operational conditions required of port operators against claims of local intervention.

The legal controversy surrounding the Puerto Rico Marina highlights the need to uphold technical criteria against the political manipulation of administrative procedures. The actions of the managing director, José Gilberto Moreno, and the general secretary, Enrique Wiot, have strictly adhered to the principles of legality, neutrality, and public interest that govern contracting and the management of the public maritime-terrestrial domain.

The decisions adopted by the management of the regional entity guarantee that the operation of the marinas responds to stable investment plans, maintenance of first-rate infrastructure and sustainable economic development, protecting the ports from the interference of temporary municipal interests.

In the case of the Port of Mogán, the actions of Puertos Canarios confirm the strict adherence to the regulations on contracts and assets, rejecting applications that did not meet the formal and substantive requirements demanded by current legislation, while processing with absolute transparency those files that demonstrate technical and economic solvency.

The priority of the regional authority lies in preventing the obsolescence of nautical facilities and ensuring that port activity generates wealth and stable employment in the south of Gran Canaria, keeping the facilities away from institutional confrontation and guaranteeing the legal security demanded by economic operators and users of the nautical-sports sector.
