On February 4, 2022, the Official Gazette of the Canary Islands published the announcement of January 24, 2022, by which the Resolution of the Vice-Minister of Infrastructure and Transport is made public, which subjects the Administrations to the public information and consultation process. affected and people interested in the action “Variant of the GC-200 Pueblo de Mogán”, promoted by that Department.
The project that is being promoted by the Government of the Canary Islands in collaboration with the Mogán City Council, is being the subject of social protest by the residents of the Mogán Valley who see how the proposed variant for the GC-200 could mean ending the landscape richness and the agricultural reserve of the Mogán Valley. This initiative aims to divert traffic from the GC-200 as it passes through the center of the southern municipality.
From Nueva Canarias (NC), the file published by the Department of Infrastructure and Transport of the Government of the Canary Islands has been reviewed, and allegations have been presented to it, understanding that the legal means used to process the file does not comply with the Land and Land Law. of the Protected Natural Spaces of the Canary Islands and with the Environmental Assessment Law.
Therefore, the nationalist party argues that the requirements set out in Article 168 of the Land Law are not met, since there are no " justified reasons of relevant public, social or economic interest." In order to proceed with the modification of planning in accordance with the aforementioned precept, the presence of a general interest that motivates the adoption of this exceptional measure is required, which is what the legal services of the Government of the Canary Islands repeatedly maintain, as they expressed in the report of January 16, 2017, issued for a similar matter.
This implies that as an exceptional power, its use must be sufficiently justified, the invocation that municipal or supramunicipal planning “negatively affects the regional interest” is not sufficient, since there may be many degrees of affectation and not all of them should justify the suspension. For this reason, the urgent reasons that recommend the adoption of this measure and the undesirable effects that would arise for said interest from maintaining the validity of the plan must be explained.
On the other hand, NC states that the Strategic Environmental Document does not comply with the requirements indicated in Annex IV of Law 21/2013, of December 9, on Environmental Assessment, since it does not even analyze the probable evolution of the environment. in case of non-application of the document, nor the existing environmental problems that are relevant for the processing of the exceptional procedure for suspension of the validity of the regulation. Nor are the possible interactions of the development of the document (variant) analyzed with the Tauro Natural Monument (C-17) or with the Nublo Rural Park (C-11), both belonging to the Network of Natural Spaces of the Canary Islands and the Network Natura 2000, where the geomorphological formations would be altered as a consequence of the execution of the determinations of the document.
For NC, there is no particular study, nor an adequate evaluation of the carbon footprint associated with the document, material assets, cultural heritage, landscape and the interrelationship between these factors. These effects must include secondary, cumulative, synergistic, short, medium and long term, permanent and temporary, positive and negative effects, among other issues.
Despite these shortcomings, the alternative agreed upon in the offices has been imposed on the residents who have been excluded from any debate forum that may have occurred between the public representatives of the Mogán City Council and the Government of the Canary Islands.
For NC, it is essential that these types of projects have consensus and neighborhood support as they will generate a great impact on what the Mogán Valley has historically been.
The nationalist formation requests the paralysis of the initiative so that a space for reflection is opened with the neighbors, in which new proposals are evaluated, and a solution that generates greater social consensus is sought.
