The holding company originating in Tunte, San Bartolomé de Tirajana, Grupo Santana Cazorla, already has an administrator since this weekend. The Commercial Court No. 2 of Las Palmas de Gran Canaria has confirmed to Maspalomas24H that the bankruptcy structure of the family business, which owns the management of Anfi del Mar together with Lopesan, has fallen into the hands of Insol Expertos, a company specialized in bankruptcies located in Valencia. This bankruptcy management has to be shared with the Canarian company Ronda y Vidal, on Avenida Alcalde Ramírez Bethencourt, owned by the prestigious Canarian commercial lawyer Eugenio Vidal. That company will be the one that creditors must contact within one month from April 8.
The Santana Cazorla bankruptcy is an ordinary procedure and in this case voluntary that is in a first phase. The magistrate investigating the case, Guillermo Fernández, has signed an order indicating that the management of the holding company will retain the powers of administration and disposal over its assets, the exercise of these being subject to the intervention of the bankruptcy administrators, through their authorization or compliance.
In the legal rigmarole that this bankruptcy has caused, among other reasons, is that in 2019 the First Section of the Contentious-Administrative Chamber of the Supreme Court (TS) has inadmissible the appeal presented by Santana Cazorla against the Court's ruling National that partially upholds the ordinary procedure filed against the ministerial order of November 2011 granting the exploitation of the Anfi del Mar commercial zone.
In this way, Santana Cazorla loses the concession to operate the leisure and commercial areas of La Verga beach - known as Anfi del Mar -, which returns to the Coastal demarcation, which it already communicated last October to the City Council. of Mogán its priority when exploiting both this area and others in the municipality.
In this regard, sources in the sector value the amount of more than 21 million euros earned by Santana Cazorla between 2022 and 2019 due to the rental of these premises and beach facilities, at a rate of just over three million euros annually. According to the ruling, the ministerial order, issued by the General Director of Sustainability of the Coast and the Sea, granted a concession to occupy some 145.381 square meters of public maritime-terrestrial property for the creation, adaptation and maintenance of various facilities in the municipality of Mogán.
Thus, the Chamber agreed to reject the appeal for processing due to non-compliance with the requirements that article 89.2 of the LJCA imposes on the document preparing the appeal as it lacked sufficient grounds. Finally, the procedural costs have been awarded to the appellant, whose maximum quantitative limit, for all concepts, is set at 1.000 euros in favor of the respondent and individual party, Anfi del Mar SL, although it was not considered to agree to an imposition of the costs in favor of the General Administration of the State.
