It was all laughter and parties since 2012. It has been 10 years of paperwork and, finally, it is Justice that defends the south of Gran Canaria from having a tourist product in the heart of the tourist center that competed with the island itself. Maspalomas24H has already announced the business discomfort in the south of the island of offering the same product in Gran Canaria and Tenerife with the same brand. This Thursday it became known that Chamber III of the Supreme Court has overturned the theses of the Gran Canaria Island Water Council that packaged the presence of Siam Park in El Veril in a regulatory change.
The instrument developed was the Plan for Modernization, Improvement and Increased Competitiveness in the area of El Veril to put Siam Park on this land, with the promoter company Loro Parque La Sala declaring the nullity of the Plan arguing, in the Eighth Legal Basis of The ruling, which lacks the mandatory report from the Insular Water Council on the existence of the necessary water resources, a requirement imposed in art. 15 of Legislative RD 2/2008, which approves the consolidated text of the Land Law (current art. 22 of Royal Legislative Decree 7/2015, which approves the Consolidated Text of the Land and Urban Rehabilitation Law ) considering that the report contained in the actions does not meet the minimum substantive requirements in relation to the existence and current sufficiency of water resources to meet the new demands derived from the Modernization Plan (which entails the construction of a water park, a hotel , restaurants and cafes).
The ruling indicates that in the allegations and evidence provided to the procedure "the aforementioned concession abstracted from said requirement and focused on one of the circumstances that this report from the Hydraulic Administration must prove." And thus, taking into account that the park had to be installed on land of public hydraulic domain, what results from the actions is that the procedure for said concession - processed by the Hydraulic Administration - focused on the conditions of said installation in those lands, but not in the availability of resources".
