Ciuca approves in Mogán a budget modification for more than three million, ignoring the municipal auditor's report

The auditor states in his report that the criteria applied to the price review are harmful to municipal interests and beneficial to the company providing the service, the commercial company Caseur.

 Yesterday, Thursday, July 14, the Mogán government gave way to the approval of the file that begins the budget modification, which will allow the company Caseur to collect €3.180.154,47 as a review of prices.

 

 The Caseur entity has been the provider of the solid waste collection service for the municipality of Mogán from May 26, 1992 to August 31, 2020, being the subject of several seizures due to the serious deficiencies detected in the provision of the service that were from the non-payment of payroll to the lack of inspection of the trucks that transported the garbage to the Juan Grande landfill.

 

This contract has undergone modifications resulting from the expansion of the scope of service provision, which has clearly affected the unforeseen costs that the company has had to face. In this way, several price reviews have been approved, the last corresponding to the period 2009-2013. 

 

It is at this time of processing the file, when the outgoing auditor, Francisco de Haro, issued a report in June 2016, in the second point of which he clearly stated that the criteria that have been applied to price reviews since the year 1993, are harmful to municipal interests, and clearly beneficial to the company, concluding that it is essential to deviate from the criteria followed in the previous review carried out in 2009 and adopt new criteria with the change being duly motivated, as established in art. 54 of Law 30/1992, today art. 35 of Law 39/2015 of October 1. 

 

Given this devastating report, the current accidental secretary of the Corporation Salvador Álvarez León, issued a report on May 17, 2021, five years after the one issued by the auditor, in which he downplays the importance of the auditor's statement regarding how harmful The price review system agreed upon with the company and applied until 2009 has been for the City Council. The report turns a deaf ear to this issue, and is committed to maintaining those same criteria on which the auditor states that they only benefit the company. The informant puts an agreement that is harmful to public interests before an agreement using the theory of the administration's own acts, turning his back on the real possibility of introducing changes in said agreement, using the route described by the intervener under protection. of what is established in art. 54 of Law 30/1992 (already repealed), today art. 35 of Law 39/2015 of October 1 (in force since 2016), a way that makes it possible to adopt new criteria as long as these are done in a duly motivated manner, and prevent damage to municipal interests.

 

Thus, and faced with a new price review, which runs from 2014 to 2020, the Mogán City Council has maintained the same price review criteria that it has been applying since 1.993, ignoring the warnings of the municipal auditor. in this regard, and quantifying said price revision in the more than three million approved by the plenary session held in Mogán yesterday.

 

The file approved in plenary, by the Onalia Bueno government group, lacks a report that explains where these three million euros come from, and that details what concepts each expense corresponds to.

 

In this sense, NC will request clarification from the current municipal auditor, if it is appropriate to carry out a price review related to the periods in which the service was hijacked by the Mogán City Council, which was the one who assumed all the expenses and not the company. .

 

For NC, it makes no sense for the Caseur entity to be paid any amount in these concepts, when it was the City Council and not it, that provided the service and assumed all the costs derived from its management. It is as if someone were paid for a job that someone else has done in their place, explained councilor Isabel Santiago.

 

 NC will present allegations against this budget modification, for not being duly justified, for deviating from the criteria of the municipal auditor, and because if approved it could be committing an alleged crime of prevarication and embezzlement

Isabel Santiago expressed that she hopes that sanity and the defense of the general interest prevail, as well as that Onalia Bueno and her government group rectify and choose to bet on the public over the possible defense of business interests.
