The candidate of Nueva Canarias – Canarista Block, for the mayor of Mogán, Javier Romero, has presented a letter addressed to the mayor of Mogán, Onalia Bueno, and the secretary of the Corporation through which he informs them of the appearance of documents public with data of some minor users of the former Ma Jesús Ramírez 'Ositos' Nursery School scattered throughout the facilities and without any type of control.
In said writing, he also points out that the politicians of the Mogán City Council are responsible for this situation, as they have omitted the duty of custody of public documents that contain sensitive information on minors and their families.
In September 2020, the Mogán City Council began the nursery school service in Arguineguín in a new facility, leaving the old one located on No. 4 Pedro Perdomo Street unused.
For more than 3 years the old facility has remained empty, unused, until this year when Mogán put out to tender the demolition of the facility for an amount of around 70.000 euros.
In recent days we have received a series of photographs of the interior of the facility once the doors and windows have been removed, without having made any enclosure of the facility, in which we can see how there are numerous photographs of minors users of the former nursery school, as well as documentation with personal data of the minors and families who use the center.
For Javier Romero, it is very serious that the public administration of Mogán, which must ensure the personal data of the residents of the municipality, users of public services, leaves lying in a disused facility and now about to be demolished, personal and private documentation, without relevant control or custody.
In Spain, the destruction of information is regulated in the Regulations of the Organic Law on Data Protection (LOPD), specifically in its Article 92.4 it states:
"Art. 92.4 Whenever any document or medium containing personal data is to be discarded, it must be destroyed or erased, by adopting measures aimed at preventing access to the information contained therein or its subsequent recovery.
Penalties range from €900 for minor infractions; €40.000 for serious offenses and even up to €600.000 for very serious infringements in relation to non-compliance with the LOPD.
The candidate from Nueva Canarias – Canarista Block, demands that this situation be resolved immediately and the protection of the data of minors be guaranteed.
