The representatives of the UTE that provide the service of Beach Cleaning, Promenades, collection of urban and domestic waste, street cleaning and other similar services, and the works council signed, in March of this year, a Pre-Agreement of Collective Agreement in the that the company requested the Administration to update the salaries on the payrolls starting in the month of May 2023 and immediately begin the process of calculating arrears, with the commitment to credit them on the July payroll. After presenting the minutes of the pre-agreement of the Collective Agreement to the Administration, the then mayor requested a report on the economic quantification of the pre-agreement presented by the UTE in the contract fee, the administrative clauses of the Technical Prescription specifications and the Administrative clauses that govern the contracting of the service, for the purposes of the revisions of the Collective Agreements. The technician's report, signed on May 10, 2023, indicates that the revision of the fee "must have the prior and binding approval of the contracting body."
In turn, regarding the Technical Prescription Document, the report indicates that both the review of the Collective Labor Agreement, the staff relationship, and the stipulation with employees of agreements, pacts or contracts, in which remuneration conditions or of work, "must be consulted and ratified by the municipal Corporation, and will refrain from adopting any commitment without the prior and express authorization of the municipal plenary session."
However, despite Narváez having unfavorable reports to approve this salary increase, ignoring the stipulations of the specifications, and given the strike call announced for May 13 (beginning of this year's municipal electoral campaign); On May 11, the former mayor sent a letter to the UTE with which she showed and signed her “commitment” and expressed “agreement with the conditions agreed upon and reflected in the Pre-Agreement Minutes of the Collective Agreement” requesting the company to “ proceed to the signing of the Agreement.” Given this, the Intervention report clarifies that "the letter sent does not in any way bind the City Council towards the UTE because the Corporation in full is the competent collegiate body for the approval of a price review of the contract, and not the "Mayor-Presidency, said letter lacking legal basis and legal coverage that binds this City Council in any way."
This agreement, reports the mayor of San Bartolomé de Tirajana, Marco Aurelio Pérez, “lacks validity as it was not approved by the municipal plenary session and is the result of a totally irresponsible, clearly electoralist act that served Narváez to save the electoral campaign. without worrying about the company, its employees, much less the cleaning service provided in the municipality.” Pérez regrets that the “electoral rush has misled the company, the union representatives and the workers” given that the commitment signed without a legal report or from the Intervention, and therefore, without a budget allocation “makes it impossible to make facing for the moment the increase proposed by the company and its union representatives”
