In the ordinary session of the Mogán Plenary Session, held this Friday, October 29, files related to the expropriation were approved urgently.
Specifically, where Plaza Negra and the David Jiménez Silva Sports Complex are located. The Mogán City Council rejects the appraisals carried out by the owners, the Del Castillo family, considering them excessive and proposes others. To meet the amount that is finally agreed upon for both expropriations, the City Council is forced to request a loan.
In April 2014, the Del Castillo family filed complaints for not initiating the Mogán City Council, then governed by the Popular Party, with the corresponding expropriation proceedings after the legally established period of three years had elapsed since the approval of the Subsidiary Standards. Months later that same year, the owners claimed 17.828.326,50 euros and 14.653.786,90 euros for the Plaza Negra and the sports grounds respectively.
However, in May 2015 the City Council rejected the requests to initiate the expropriation made by the Del Castillo family, the latter responding with the filing of contentious administrative appeals whose sentences recognize their right to have the expropriation proceedings initiated on May 15, 2015. XNUMX.
In this Friday's session, the Mogán City Council has agreed, with the vote in favor of the Government group (CIUCA) and the abstention of PSOE and PP, to reject the appraisals of the Del Castillo family, and has presented a valuation of the land own which amounts to 2.634.174,52 euros for the 7.015,48 square meters of the Plaza Negra and 8.875.186,56 euros for the 23.204,91 square meters of the sports area. The so-called Appreciation Sheets of these expropriations will be communicated to the Del Castillo family, who has a period of ten business days to accept or reject them.
If they are rejected, the files must be transferred to the Canary Islands Valuation Commission, an organization that will have to resolve the matter, always based on the appraisal proposals of the Consistory. The mayor of Mogán, Onalia Bueno, has explained that if an amount is not agreed upon by Del Castillo, the City Council and the
Valuation Commission "we will have to go to Court", which would foreseeably lead to a delay in the process and that "the late payment interest becomes greater than the principal capital." To avoid the latter, Bueno has assured that the City Council will pay an economic deposit to prevent them from being generated. “At no cost do we want to cause greater damage to the municipal coffers. If the previous government groups had made a responsible decision like this, today we Moganeros and Moganeras would not continue paying for expropriations from the 2000s and the 2010s, especially the late payment interest on these.”
Whether the financial deposit is necessary or if the Del Castillo family accepts the appraisals proposed by the Mogán City Council, the local Administration will have to request a loan to be able to face the cost of both expropriations, and it is not the first time that it has had to resort to it. It still continues to pay the credit of more than 10 million euros to settle the debt incurred in 2003 for the expropriation of the municipal cemetery land.
The mayor has expressed feeling “deep sadness for the money that we have to divert to pay interest on late payment of these expropriations and not being able to invest it in the improvement of infrastructure and services of the municipality in order to advance at a greater speed in the pending actions and projects. of execution".
Other issues
The session also initially approved a budget modification of 1.444.205,09 euros to comply with different court rulings. Of this total amount, 1.295.558,82 euros will be used to pay the Del Castillo family late payment and procedural interest since 2013 for the expropriation of the land in Loma de Pino Seco, where social housing is located today.
Likewise, 88.646,27 euros to cover late payment and procedural interests for the expropriation of two properties near the municipal cemetery in a procedure that dates back to 2006. The budget modification was approved with the vote in favor of the Government group (CIUCA) and PP , and the abstention of the PSOE.
