Mogán terminates the street cleaning contract

In the ordinary session of the Mogán Plenary Session held this Friday, October 27, it was unanimously agreed by the groups present to resolve the management contract for the public street cleaning service, a procedure motivated by the repeated non-compliance with the specifications by the successful bidder. UTE Mogán Limpio, entity formed by Ascan Servicios Urbanos SL and General de Asfaltos y Servicios SL

The contract was awarded in 2014 by the then Government group led by the PP, and went into execution on January 1, 2015 for a maximum period of 10 years despite the issuance of two unfavorable minutes of the start of the service due to non-compliance with the commercial organization of its obligations regarding the personal and material resources to be assigned, fixed facilities, Service Management Plan, as well as the proposal presented by it in relation to the improvements offered.

 

Since the beginning of the service, technical and legal reports have been issued that propose the termination of the contract due to the existence of non-compliance, especially for two services that UTE Mogán Limpio refuses to provide and which were considered the basis criteria for the award of the contract: the awareness campaign and the gum removal campaign. Both added 30% of the total criteria evaluated in the tender and thanks to that offer that they are now not willing to make, they obtained the maximum score and, consequently, won the contract. 

 

Based on all this, the procedure to terminate it was initiated on three previous occasions. The first in 2015, which was not resolved, while the second was in 2019, the matter being transferred to the Contentious-Administrative Court by the entity. The City Council acquiesced and proposed reaching an agreement with UTE Mogán Limpio, which it did not accept despite continuing to fail to comply with the provisions of the contract. In 2021 the procedure was started again, but it expired again due to the limited administrative period to resolve taking into account the allegations presented by UTE Mogán Limpio, for which the proposed resolution must be transferred to the Consultative Council of the Canary Islands and this last issue opinion. 

 

The last time that the Plenary agreed to start the file was last March, but now that the criteria of the bodies in matters of contracting has changed with respect to expiration, the City Council has been able to comply with the established deadlines in a timely manner. . As things stand, this morning the allegations were dismissed and the termination of the contract was approved. In addition, the guarantee will be seized to make effective compensation for the damages caused, and the necessary measures will be adopted to avoid a serious disruption to the public service.

 

“Thank all the workers for the work they have done over all these years, having even expressed their disagreement with the company,” said Mayor Onalia Bueno during the debate. “They have been aware of the numerous occasions in which this Government group has tried to resolve the contract and that due to administrative work it had been impossible. Fortunately, the situation has now been unblocked, we are going to resolve the contract and correct all those aspects that this contract does not resolve today,” she said. 

 

Next Tuesday, October 31, the need and suitability of a new contract for the public street cleaning service will be brought to the Local Government Board, as well as the file to be initiated to carry out its contracting.

 

Motion

 

Nueva Canarias-Bloque Canarista presented a motion requesting that the corresponding procedure be initiated to change the name of CEIP Playa de Arguineguín to CEIP Rosa Martín Cabrera, in recognition of the work and social career of this neighbor, who died last August. 

 

However, despite agreeing with the document's description of Dª Rosa, as she was known by the neighbors, Juntos Por Mogán has proposed that the name could be replaced by the following: CEIP Playa de Arguineguín Rosa Martín Cabrera.

In this way, as explained by the Councilor for Education, Emily Quintana, “the center would maintain the name that has given it its hallmark and would gain recognition for a teacher, neighbor and friend of all of us.” Furthermore, this is the opinion of the center's management team, who after learning of the motion, expressed their refusal to stop being called Playa de Arguineguín because they consider its current name gives it identity.

 

In the municipality, the work of Rosa Martín Cabrera is known. In 1965 she requested a transfer to Colegio Playa de Arguineguín, where she remained until 1996, where she also served as director. A teacher by vocation, she firmly believed in the learning capacity of all students and her great involvement in giving support classes outside of school hours and directly helping the most needy families of that time. Her professional career culminated at IES Arguineguín, leaving an indelible mark on all those to whom she taught the Spanish Language subject, being known for her infallible techniques to transmit knowledge. 

 

The motion has been approved by all groups present to begin the procedure and for the educational change to be nominated as CEIP Playa de Arguineguín Rosa Martín Cabrera.
