This Friday, the Plenary Session of the Municipal Corporation of the City Council of San Bartolomé de Tirajana unanimously granted its final approval to the Partial Plan for Montaña La Data, a fact that allows the legalization of some 600 homes already built, and the availability of land to build another 500.
Reaching this final approval has not been easy. The first deputy mayor, Alejandro Marichal, recalled that the Montaña La Data reparcelling project was already approved for the first time in 1996, but was declared null and void in 2003 due to the legal demands it received, and after restarting the entire procedure, the Plan It was submitted again for initial approval in 2014. In addition, “the file suffered a significant slowdown in 2017 as a result of the change in the Canary Islands Land Law,” highlighted Mayor Marco Aurelio Pérez.
Both the mayor and the Urban Planning councilor alluded to the “historical milestone” that this final approval represents, and insisted that it has been a “complex and tedious” process, which is why they asked the neighbors to “preserve their legal security and not judicialize” so that the City Council can continue with the second step of the urban planning procedure.
"On the part of the City Council we extend our hand to you and guarantee you our absolute collaboration to begin the second process that will also be complex and that we intend to carry out in cooperation, where the City Council will assume as promoter the urbanization and reparcelling of the developable land and will not consolidated, which will allow the development of the Partial Plan,” stated Marichal.
“It is important that we review this plenary session as a milestone, because it has been a tedious process where legislative changes have put a brake on its development, and because of the impetus that has been given to it in this last half of 2023 for its final approval” said Marco Aurelio Pérez, who stressed “the need for this approval to have legal certainty, so that this document has life and we can give way to the development and urban management instruments of the Plan. We think that, as it is designed, the different private operators and commercial companies with properties in that area will be able to reap the fruits of this urban planning,” he stated.
Alejandro Marichal explained that with the final approval of the Partial Plan, the Montaña La Data sector, with a total area of approximately 440.800 m², is divided into three large blocks. On the one hand, a consolidated urban land of 180.000 m² in which owners without a qualifying title will be able to begin the legalization process; on the other, some 159.000 m² of unconsolidated urban land, where the urbanization is not completed and will require the coordination of urbanization, reparcelling and compensation projects. “Presumably it will be the City Council that will assume the task of promoting this urban management if this approval becomes final and we can move forward with the process,” Marichal said. The last sector comprises 101.400 m² of developable land.
The approved urban planning specifies a plot of 500 m² on average with an average buildable area of 0,5 m², “so each plot could fit a 250 m² home with a maximum height of two floors,” stated the first deputy mayor. , who highlighted that in the consolidated urban land, where licenses already exist, more than 600 homes can be legalized and another 500 new ones can be built.
