Davinia Ramírez, Councilor for Urban Planning: “We warn the developer that non-compliance will mean adopting measures such as the removal of machinery and materials or fines of up to 2.000 euros”
Alejandro Marichal: “It is a priority to defend the rights and well-being of the neighbors, in this case of Juan Grande and El Matorral, who are affected by illegal works like this one. Our priority is that economic growth and social well-being coexist”
The Department of Urban Planning of the City Council of San Bartolomé de Tirajana, through the Urban Discipline area, has ordered the Local Police to proceed with the immediate sealing of the works initiated by the entity Energy Solutions by Scandinavians consisting of the installation of materials and placement of concrete and metal structures, as well as the installation of containers in Polígono 11, plots from 51 to 53, in El Matorral as the promoter lacks an enabling title for the installation of a photovoltaic park.
The order has been decreed by the Department of Urban Planning, whose head, Davinia Ramírez (CC), explains that after the report issued by agents of the Local Police in which they reported on the works of perimeter fencing and installation of material in the indicated area, it was confirmed that there are two files, one for the installation of fencing on the indicated plots and another for the installation of a photovoltaic park, but "the entity does not have a prior license to begin the actions referred to in the file."
For this reason, and in order to put an end to the works, restore urban planning legality and safeguard the public interests and affected third parties, an immediate seal has been decreed and the promoter is granted a period of ten days in order to formulate allegations or present the documents it deems appropriate, so that a final decision can be made on the maintenance, modification or lifting of the adopted measure.
Ramírez points out that in said order the promoter is warned that non-compliance will entail the adoption of different measures such as the removal of machinery and materials; the imposition of coercive fines, every ten days, for an amount of up to 2.000 euros, depending on the urban planning actions that have been undertaken and the companies supplying electricity, gas, telephone... are required not to grant the supply of the corresponding services.
