Mogán updates the municipal taxi regulations

In the ordinary session of the Mogán Plenary Session held this Friday, May 3, the modification of the Municipal Transport Regulations was approved for its adaptation to current legislation and the latest jurisprudence, adapting the text for reasons of effectiveness and adapting it to different judicial pronouncements, as well as addressing some of the proposals made by the Mogán Autotaxis Cooperative.

 

 

The modification, approved by the Government group (Together for Mogán) and NC-BC and abstention of the PSOE, complies with the principles of good regulation included in Law 39/2015, of October 1, of the Common Administrative Procedure of the Public Administrations. Also to the recent jurisprudence regarding taxi service providers, so that it is consistent with the rest of the legal system and mainly with the specific legislation referring to the taxi service.

 

Thus, article 103 is modified for the effectiveness and correct definition of the necessary documentation regarding the replacement of autotaxi vehicles, in accordance with what is established by Law 13/2007, of May 17, on the Regulation of the Canary Islands road transport. 

 

Article 104, which includes the physical characteristics of the vehicles that provide the autotaxi service, has seen a drafting error, which is why it is modified so that it cannot lead to contradictions with regard to transparency or window tinting, in addition to taking into consideration the provision of greater comfort to vehicles in this aspect.

 

Likewise, new sections are added to this article that state, among others, that vehicles must be equipped with a receipt-dispensing printer, approved and authorized for use in the taxi service; with a card charging system (POS), and may also have any other equivalent electronic charging system; air conditioning and/or air conditioning; They may be equipped with a GPS system; They may be provided with a safety partition separating the driver and users, whose characteristics are in accordance with those established and approved by the competent authorities; They may be equipped with communication systems or security cameras; the vehicle upholstery must be in good condition; The carrying out of any modification to the vehicle that affects any of its characteristics, in addition to meeting the requirements set out in this Regulation, must have the authorizations that depend on the competent bodies in matters of Industry and Traffic, and must be communicated. to the Municipal Administration.

 

On the other hand, article 105 changes to adapt the vehicles that provide the autotaxi service in Mogán to the new corporate image of the City Council as well as its logos. The modification of 136 is also proposed, referring to the "exploitation of the Autotaxis license requirements", adding a new section in which it is established that the mere presentation of the prior communication accompanied by the required documentation will be a valid title for the start of the activity from the day of its presentation.

 

Articles 150 and 152 were modified to adapt the text to the different judicial rulings that have been issued regarding the requirements to be able to be a taxi driver and specifically with respect to the consideration of criminal records as a requirement to carry out the activity. . 

 

Finally, 155 is modified, referring to the uniforms of the drivers, thus responding to the request of the Mogán Autotaxis Cooperative. Specifically, it is proposed that in cases of high temperatures it is allowed to wear the summer uniform, even during the winter season. In addition, specific garments are defined, given that those hitherto listed in the Regulation are no longer on the market.

 

The agreement will be published on the Town Hall notice board, on the municipal website as well as in the Official Bulletin of the Province for a minimum period of thirty days, within which interested parties may examine the file and present any claims they deem. timely.
