The judicial authorities have requested sentences of more than three years in prison in the event that the payment of penalties for the transfer, among others, of the FM license of Radio Maspalomas without permission of the owner of the concession is not carried out, that is, the Government of the Canary Islands. The Prosecutor's Office has denounced the existence of asset seizure and requests that the transmission of the FM (95 MHz) and San Bartolomé de Tirajana (Maspalomas 95.3 MHz) licenses of which Radio Las Palmas is the owner be declared null and void.
In the accusation of the Prosecutor's Office, to which Maspalomas24H has had access, it is indicated that on June 30, 2015 it was issued by the Court of First Instance 8 of La Palmas, within the procedure for the Execution of Judicial Titles, derived from a monitoring process requiring payment to the entity EAJ-50 Radio Las Palmas whose administrator is the defendant, and with no criminal record, which as an executed party was sentenced to pay the commercial entity Prima Gran Canaria the amount of 923.447 euros without being paid .
On February 28, 2018, decree 18/2018 was published in the BOC, authorizing the transmission of the FM licenses of Las Palmas and Maspalomas owned by EAJ-50 Radio Las Palmas in favor of Inolvidable FM. , SL, created in 2016 whose administrator is the defendant JFS of legal age, and without a criminal record. So the two licenses or administrative concessions transmitted by the Radio Las Palmas entity and that constituted the assets of the aforementioned entity were executed.
"The defendants, by mutual agreement, acted with the purpose of harming the right to collection of the aforementioned credit when the commercial company EAJ-50 Radio Las Palmas gave up the aforementioned licenses, requesting on October 4, 2017 to the Presidency of the Government of the Canary Islands the authorization to transmit the same together with other assets, in favor of Inolvidable FM, thus not being able to pay for that already judicialized debt, which led to declaring the Bankruptcy of the same by Order of April 4, 2018, thus frustrating the legitimate expectation of collection from the Prima Gran Canaria entity".
For the Prosecutor's Office, the events narrated constitute a "crime of theft of assets" and asks those accused to be sentenced to 3 years and six months in prison and a 24-month fine with a daily fee of 15 euros with the accessory of special disqualification. for the right to passive suffrage during the time of the sentence.
