The Plenary Session of the Municipal Corporation of San Bartolomé de Tirajana approved this Thursday to declare the “extraordinary and urgent public need” and 'social interest' of the provisional ordinance that is expected to be drafted immediately to order the provisional compatibility of tourist and residential uses in homogeneous plots of the entire coastal tourist area of ​​the municipality. The proposal was approved by the municipal government with the favorable support of the socialist councilors and the vote against the NC group.

The first deputy mayor, Alejandro Marichal, explained that the proposal of the Department of Urban Planning directed by Davinia Ramírez aims to provide greater legal security to the residents who reside in the plots where the detailed municipal planning forms establish the name of “ apartments or holiday homes bungalows.”

 

The drafting of this Provisional Ordinance for urgent processing is already in process. Marichal maintains that “it is a crucial step to resolve the confusion that affects many owners and residents in the tourist area. We want to ensure that our urban planning regulations reflect the reality and current needs of the municipality, and for that we will have to adapt the General Plan, to allow a balanced and orderly coexistence of tourist and residential uses, offering greater legal security to the neighbors. "in order to paralyze the sanctioning proceedings initiated by the Tourism Department of the Government of the Canary Islands."

 

In that sense, the technical report that endorses the proposal submitted to the plenary session warns that the Provisional Ordinance will serve as a complement to urban planning, and that its duration "will be ephemeral, since it will be replaced in due course by the modification of the General Plan itself." It also admits that the Ordinance "will not condition future planning, since the specialization of the plots will be carried out through a deep and detailed study of each one."

 

Marichal stated that what is intended with the ordinance is that "in the urban planning files of the plots - in addition to the building typology - the permanent residential use is detailed compatible with that of a second residence." He also stated that the ordinance will take a few months to be drafted, and that before being raised to the plenary session it will be submitted for consultation to the municipal environmental body.

 

Marichal concluded that this action responds to “a tourism model that gives identity to the destination and places value on people, as a tourist city that integrates tourists with the people who reside and live here. No person who is residing in the tourist area is against tourism, quite the opposite. “Our tourism model is reviewable, and what we are proposing is a change in the way we understand it: that those who come integrate with the culture and the people who live here, and not create ghettos or industrial estates,” he said.

 

Mayor Marco Aurelio Pérez clarified that it was the Tourism Department of the Government of the Canary Islands that ordered the City Council to draft the provisional ordinance in order to act on the sanctions. “This is a municipal ordinance that will be processed and approved by this City Council and the Government of the Canary Islands will only be able to act against it in the courts, because this city council is sovereign and is capable of approving it,” he stated.
