They were not children. The Criminal Chamber of the Supreme Court has handed down a sentence of three and a half years and expulsion from Spain to two minors who arrived by boat or cayuco to Gran Canaria who in 2021 tried to rape a monitor from a center in the south of Gran Canaria, according to the ruling from this summer of 2024 to which Maspalomas24H has had access. The sexual assault was not carried out with penetration because the woman was able to escape hearing them laughing at her and with fear in her body.

The proven facts of the sentence state, in summary, that, around 22:15 p.m. on May 12, 2021, in one of the rooms of the juvenile center in the south of Gran Canaria where the two Menas spent the night, when the The center's technical assistant was announcing room by room that it was time for dinner, the two defendants held her hands as a sign of greeting, asking her what her name was and if she had a boyfriend. Although she let go of her hands, they grabbed them again and continued asking her questions, until someone lowered the light lever, and at that moment, jointly and with a clear libidinous purpose, they grabbed the technician tightly, preventing her from to move and they repeatedly touched her breasts and vagina over her clothes.

As a result of the events described above, the woman did not present any physical injuries, but she did have a tearful state and sleep problems, as well as fear, which required a single medical assistance for her recovery, estimating that she was out for one day, without sequelae, due to the which claims the pertinent compensation, as well as for the moral damage caused. The Menas, it is not known how, must compensate the monitor in the amount of 2.000 euros in moral damages and take a sexual education course. Since the defendants are in an illegal situation in Spain, it is agreed to replace the prison sentence with their expulsion from the national territory, once two-thirds of the sentence imposed has been served, with a ban on entry into Spain for a period of 10 years.

In the monitor's complaint to the National Police of Maspalomas and the Investigative Court No. 2 of San Bartolomé de Tirajana, the verisimilitude of the testimony has been proven, in addition to the medical report issued by the Health Center to which the complainant went after the events, where the psychological impact that the sexual assault suffered had caused him is recorded, which led to the prescription of medical treatment; and, on the other, the forensic medical report, duly where the psychological consequences of the events were also objectified.
