The new legislative framework on holiday rentals has forced the creation of a website with complete information on the main aspects of the new regulation in lawcanariadeviviendavacacional.comThe regional government, meeting today in Council, has agreed to urgently send the draft Law on Sustainable Management of the Tourist Use of Housing to the Advisory Council of the Canary Islands so that it can issue the corresponding report, as the next step in its processing.
Once this body issues the mandatory opinion, which is not binding, the Government will collect the corresponding observations in order to subsequently approve the draft law in a new session before its submission to Parliament as a draft law. The Law on Sustainable Management of the Tourist Use of Housing will provide a regulatory framework to regulate holiday rentals in the Canary Islands. The Minister of Tourism and Employment, Jéssica de León, highlighted this Monday the axes on which the new Law will pivot. Faced with the current situation, when the law comes into force, no more holiday homes may be built if the urban planning does not expressly enable this use, at least for the next five years, a decision that must be decided by each of the municipal plenary sessions of San Bartolomé de Tirajana and Mogán, after public information, in a reasoned manner and in accordance with sustainability criteria.
The future Law provides for an appropriate reserve for residential use of the homes "in order to make effective the right of all Canarian citizens to decent housing at affordable prices. Likewise, he indicated, the appropriate integration of holiday homes in residential environments is guaranteed, prioritizing the quality of life of residents above all else.
The draft regional bill also includes the possibility that small owners who currently operate their homes legally, in compliance with the current decree, may continue to carry out their activity indefinitely when the new regulation comes into force, although it will not be transferable. The new legislative framework will prevent the implementation of entire buildings dedicated to holiday rentals on plots for residential use. Likewise, the text excludes the possibility that new homes that are incorporated into the market may be used for tourism in the next ten years from their completion, thus guaranteeing their residential use.
