Lopesan forced to reinstate and compensate a worker dismissed during his sick leave

The ruling, against which an appeal may be filed, also establishes that the company must pay the accrued processing salaries.

Interclub Atlantic Hotel SA, part of the Lopesan chain, was ordered to reinstate and pay 7.500 euros in compensation to a worker who worked in the maintenance department and who was dismissed, it argued, for reasons of productivity while the worker was on sick leave.

According to the ruling of the Social Court number 3 of Las Palmas de Gran Canaria, the company itself acknowledged that the dismissals carried out, a total of five, were for workers who had accumulated the most temporary disability leaves.

In this regard, the Legal Services of UGT Canarias emphasise the need to “report” these situations that go against the labour rights of workers. “We have managed to obtain recognition of both the reinstatement and compensation of our client from the dismissals carried out. It is a clear example that going to court does serve some purpose and with this ruling not only is justice done, but it also sets a precedent for others to be encouraged to file a complaint,” says Otilia Naranjo, a lawyer from the Legal Services of UGT Canarias.

The ruling, which may be appealed, also establishes that the company must pay the accrued procedural wages, in addition to the compensation mentioned above.
