A court ruling in 2025 has put an end to Puerto Rico SA's management of the marina in the south of Gran Canaria. The company, which is owned by people from Las Palmas and the Roca family, has lost the lawsuit against the Government of the Canary Islands and the Mogán City Council, who rejected the extension of the concession granted in 1972 during the Franco regime. The administrative court number 2 of Las Palmas, presided over by magistrate María García Coello, has ruled against Puerto Rico SA's request to extend the concession for another 25 years. The ruling establishes that it is not possible to admit the extension of concessions granted before the entry into force of Law 27/1992.
The company attempted to extend its control over the marina by taking legal action against Puertos Canarios and the Mogán Town Council. The conflict arose due to the administrative silence regarding the extension requests submitted in 2015 and 2021. The court ruling clarifies that private operators cannot hold concessions for more than 35 years from the entry into force of Law 27/1992.
The ruling also highlights that the current regulations at state and regional level do not allow the extension of concessions to marinas prior to 1992. The lawyers of Puerto Rico SA argued that the third provision of Law 6/14 could allow the extension, but the ruling underlines that in 2024 a final provision was introduced in the Law of State Ports that limits the extension periods in marinas. The Government of the Canary Islands and the City Council of Mogán have expressed their satisfaction with the result of the judicial resolution.
