The Provincial Court will next Wednesday judge a woman accused of falsifying private documents and fraud, who is held responsible for having provided a false bank guarantee to obtain the lease of a hotel in the south of Gran Canaria.
The defendant, MPOR, acted as representative and sole administrator of the entity HTFG Canarias Group SCP, which in July 2013 signed a lease agreement with the company Alessa Europa SL for the property, located in a tourist area in the south of Gran Canaria.
The lease was signed for a period of five years, stipulating a rent of 27.000 euros per month, "subject to the delivery, by the accused, of a prior bank guarantee for an amount of twelve monthly payments."
According to the details in the prosecution's indictment, "the accused, motivated by the desire for illicit profit", in order to gain access to the exploitation of the hotel, presented the company Alessa Europa SL in August 2013 with a guarantee corresponding to the banking entity Catalunya Caixa, for an amount of 346.680 euros.
The tenant also accumulated a debt with Social Security of 118.000 euros
The Public Prosecutor's Office stresses that it was "a completely false document, falsified by the accused herself or by a third party at her request, thereby obtaining her status as tenant of the property."
Between September 2013 and February 2014, when the lease was terminated, the defendant exploited the hotel business in the south of Gran Canaria, failing to pay numerous monthly payments, for a total amount of 119.388 euros.
As stated in the indictment, he also neglected his obligations to Social Security, which generated a debt of 118.107 euros, according to a decree of April 2015.
The Prosecutor's Office classifies the facts as constituting a crime of falsification of commercial documents, in conjunction with a crime of fraud.
The indictment calls for a prison sentence of five years and six months, as well as compensation for the hotel's property of 237.495 euros.
