The scorn leveled at the highest municipal authority for winning a first appeal against the Mogán eco-tax could prove costly for the Las Palmas hotel sector with interests in the municipality. The mayor of Mogán, Onalia Bueno, plans to announce this Friday that, within the timeframe provided by law, she will appeal the decision of the Canary Islands High Court of Justice (TSJC) to heed the advice of the hotel chains operating in her municipality, none of which have their headquarters in Mogán, against the 0,15 euro eco-tax. 

Mogán is the tourist municipality where the hotel sector is least exposed to investment funds, as the chains that comprise the Las Palmas FEHT are mostly owned by family businesses. Hotel fund managers consulted by Maspalomas24H disassociated themselves from the appeal on Thursday: "These are things that family businesses in Las Palmas do; we never act against places where we have interests." Residents and service sector company managers who support the regionalist mayor and were consulted by Maspalomas24H expect a strong response, especially since tourists come from places where eco-taxes are common practice. 

In Mogán City Council's strategy, from the outset, while the municipal appeal is admitted and a legal battle develops that the Juntos por Mogán mayor, who has the support of CC and PP, will win sooner or later, the hotel sector will have to face the first mayor and head of the Mogán Local Police and an entire administrative apparatus at their disposal.

The mayor is going to start a defense of the interests of Mogán that will go, in part, through the parameters offered by article 6.2 of the LOFCA and what it indicates in matters subject to taxation reserved to the local Corporations in the provisions of Law 39/1988, of December 28, (STC 289/2000), which indicates by "reserved matters" those that should be understood only as "those matters that configure the object of the local taxes because it has been established as such by the "local regime legislation" which in financial matters is none other, at present, than Law 39/1988, regulating Local Treasuries" (LHL).

Bueno will begin a round of "surround the FETH" initiatives by convening meetings with affected groups, including the public and private sectors, and civil society, to generate consensus and support for the idea approved at the plenary session. This will strengthen the project's viability and mitigate resistance. Furthermore, it has the capacity to delegate and organize technical teams to work on the development and justification of the measure to ensure its proper implementation and demonstrate its positive impact.

Furthermore, through strategic communication efforts, the government will inform and raise awareness among citizens about the benefits of the approved measure, mobilizing popular support as a tool to counter the opposition. This social support could be key to consolidating the legitimacy of the actions undertaken. But the main battle is the Constitutional Court: if the matter is lodged in the court in Las Palmas, the government has the right to appeal to administrative bodies and the Council of State.
