Zurich assumes property insurance coverage for the San Bartolomé de Tirajana City Council

The San Bartolomé de Tirajana City Council has awarded Zurich its new property liability insurance policy, within the framework of the open procedure under the Framework Agreement promoted by the Spanish Federation of Municipalities and Provinces (FEMP). The need for this contract, according to the technical report signed by the Head of the Urban Planning and Heritage Department and the Councilor for the area, is justified by the growing complexity of municipal activity and the property risk to which public administrations are exposed. In the last 25 years, they point out, it has become common among local authorities to take out specific insurance policies to transfer to third parties the financial effects arising from claims or damages caused during the exercise of public powers.

The policy awarded to Zurich would, in theory, cover potential personal injury, property damage, or consequential damages unintentionally caused to third parties, whether due to an action or omission in the performance of the duties of the City Council or its autonomous bodies. It would also include coverage for legal defense, fees, and potential court bonds, in accordance with the provisions of Law 39/2015 and Law 40/2015. The file, identified by administrative code 2025-003813, is being processed as a private contract and has an initial duration of one year, with the possibility of extension for an additional year, with no modifications planned. It should be noted that, according to the technical documentation, the contract has not been divided into lots, as the administration understands that it is an indivisible functional unit.

Although the award process is based on the provisions of the Public Sector Contracts Law (LCSP), specifically Articles 28, 116.1, and 99.3.b), it should be noted that these types of contracts are usually subject to subsequent review by the municipal auditing body and the Court of Auditors, so it cannot be ruled out that aspects of their processing or execution may be questioned in the future. At the moment, there are no public challenges or objections, and the City Council emphasizes the importance of having insurance that adequately covers its liability to the citizens and businesses of the municipality.
