Upcoming trial for robbery at a home in Los Caideros, Mogán

The Court of Instruction number 3 of San Bartolomé de Tirajana is processing the opening of oral proceedings against a man identified as JAAM, for an alleged burglary at an occupied residence, which occurred in April 2020 on Picasso Street, in Los Caideros, Mogán. According to the indictment filed by the Public Prosecutor's Office, the accused, an adult with a prior criminal record for a burglary committed in 2014, allegedly gained access to the residence by breaking a window with the aim of obtaining an illicit financial gain. Once inside, he allegedly stole various items valued at 168 euros, also causing property damage estimated at 201,07 euros.

The prosecution considers that the facts constitute a crime of robbery with force in an inhabited house, provided for in articles 237, 238 and 241 of the Penal Code, and requests that the accused be sentenced to 5 years in prison, along with special disqualification for the right of passive suffrage during the time of the sentence.

Furthermore, the corresponding civil liability is being sought: the defendant must compensate the victim with a total of €369,07, corresponding to the stolen items and damages caused, in addition to returning the items recovered by the police. The case will be tried soon in the Criminal Court of San Bartolomé de Tirajana, where the final sentence and the amount of financial compensation to the victim will be decided.
