The Public Prosecutor's Office confirmed to Maspalomas24H this Wednesday that it has requested a six-year prison sentence for ACG, accused of robbing the El Doctoral Senior Citizens Club in the Gran Canaria municipality of Santa Lucía de Tirajana during the early morning of December 5, 2022. The accused, with a criminal record for burglary, allegedly gained access to the municipal premises outside of opening hours after forcing open the bars of a side window, with the purpose of obtaining an illicit financial gain.
Once inside, according to the indictment, the defendant stole €2.400 from the cash register and the cigarette machine, then fled. The incident caused damage to the cash register—valued at €1.605—and to the window through which he entered the premises, valued at €158. Part of the damage was covered by insurance, which paid €300 to the owner of the establishment, identified as FACP.
The prosecutor notes that ACG is a repeat offender, with at least three prior convictions for burglary handed down by courts in Santa Cruz de Tenerife between 2012 and 2019, with sentences of up to a year and a half in prison, some of which were suspended and subsequently revoked. The prosecution considers the acts to constitute the crime of burglary of a business open to the public outside of opening hours, as defined in Articles 237, 238.2, and 241 of the Spanish Penal Code, in conjunction with Article 235.1.7.
In addition to the prison sentence, the Public Prosecutor's Office is requesting special disqualification from holding public office for the duration of the sentence and payment of court costs. Regarding civil liability, the defendant must compensate FACP with €3.705 for damages and losses suffered, and the Santa Lucía de Tirajana City Council with €158 for damages caused to the municipal building. Summary proceedings 267/2023 are being handled by the Court of Instruction Number 2 of San Bartolomé de Tirajana, formerly Mixed Court Number 7, and the Public Prosecutor's Office has requested that the case be brought to trial before the Provincial Court of Las Palmas.
