Acquittal for a National Police officer who responded to an attack with a headbutt in Maspalomas

The Public Prosecutor's Office has requested the acquittal of the two defendants, CJGT and JMH, in the context of Summary Proceedings No. 2344/2021, which investigated an alleged altercation involving headbutts at the PANAMERA nightclub in Maspalomas. Despite requesting the opening of the oral proceedings before the Criminal Court to move the case forward, the Prosecutor has submitted a motion for acquittal, arguing the complete lack of evidence to support the initial charges.

The incident, which took place on August 28, 2021, centered on allegations of mutual assault: on the one hand, it was investigated whether citizen CJGT had assaulted JMH, a National Police officer on duty for crime prevention and COVID-19 enforcement; on the other hand, it was investigated whether the police officer had reciprocally assaulted the citizen. However, the prosecution's preliminary conclusions are clear and categorical: "It has not been proven" that either of the accused carried out the actions with which they were charged.

Given the impossibility of proving the facts, the Public Prosecutor's Office has concluded that the described acts "do not constitute a crime" and, consequently, "there is no perpetrator." Therefore, the Prosecutor's Office has requested the Criminal Court to acquit CJGT and JMH, as there are no mitigating or aggravating circumstances and the accusation cannot be substantiated.
