The Public Prosecutor's Office has formally requested the opening of a trial before the Provincial Court against VMVT for an alleged continuing offense of sexual abuse of a minor under sixteen years of age, in accordance with the procedural steps outlined in Article 780.1 of the Criminal Procedure Law. The prosecution's request, submitted in a written indictment, is based on a series of preliminary findings detailing the defendant's conduct, and seeks a primary sentence of six years' imprisonment for the serious acts charged.
The indictment, to which Maspalomas24H has had access, states that the assaults allegedly occurred repeatedly between 2017 and 2019 in the municipality of San Bartolomé de Tirajana. The accused, taking advantage of his relationship with the mother of the minor (identified as NCP), allegedly used this circumstance to violate the victim's sexual integrity.
The prosecution details that, initially, the accused groped her breasts, genitals, and buttocks inside his vehicle. Subsequently, taking advantage of moments when he was alone caring for the minor at home, "on multiple occasions he groped her breasts, buttocks, and private parts, and sucked on the latter," acts that are classified as constituting a continuing offense of sexual abuse.
In addition to the prison sentence, the prosecution is demanding a series of severe supplementary measures: a 16-year restraining order prohibiting the defendant from approaching or communicating with the victim, an 11-year ban on working in any profession or occupation that involves regular and direct contact with minors, and ten years of supervised release after serving the sentence. Regarding civil liability, the prosecution is requesting that the defendant compensate the victim with €20.000 for the emotional distress suffered. The prosecution also notes that the defendant has a criminal record, including two convictions for threats in the context of gender-based violence and two for driving under the influence of alcohol or drugs.
