The Las Palmas Public Prosecutor's Office is seeking four-year prison sentences for drug trafficking and three-year sentences for illicit association for the three club directors, following an operation that seized substances valued at over €133.000. The Provincial Court of Las Palmas de Gran Canaria will hear the case against the three individuals responsible for the María Salvador Cannabis Club, located on Avenida de Canarias in Vecindario (San Bartolomé de Tirajana judicial district), for an alleged ongoing crime against public health involving substances that do not cause serious harm, and for the crime of illicit association.
The Public Prosecutor's Office has filed an indictment requesting a total of seven years in prison for the President (BR), the Secretary (EPSC), and the Treasurer (TQR) of the organization, arguing that the association was not engaged in shared consumption but rather in the sale of narcotics to third parties. According to the indictment, BR, EPSC, and TQR, acting as the club's leadership, "sold narcotics to third parties." The legal proceedings began after detailed surveillance by law enforcement agencies, who documented numerous instances of people leaving the premises with plant or resinous substances, though in most initial cases, the substances were not analyzed.
Between 2018 and 2019, authorities recorded at least eleven sales incidents. In several of these operations, the substances seized from buyers were confirmed to be cannabis and resin. The operation on October 17, 2019, stands out, in which 9,76 grams of resin and 20,81 grams of cannabis were seized from a buyer. As a result of the detected sales, the Court of Instruction Number 3 of San Bartolomé de Tirajana authorized a search warrant for the premises in November 2019. Inside, officers found a large quantity of product intended for sale, as well as numerous processed products.
The total amount of substances seized at the premises was: 10.313,84 grams of cannabis, 3.544,35 grams of THC, and 4.565,02 grams of cannabis oil. The total market value of all the seized substances (including those belonging to the buyers) was estimated at €133.015,21. The prosecution argues that the defendants possessed these substances "with the intention of obtaining an illicit profit through their sale, thereby endangering the individual and collective health of others."
For the crime against public health, the prosecution is requesting a four-year prison sentence and a fine of €532.060 for each of the defendants. Additionally, for the crime of belonging to an illegal organization, the prosecution is requesting a three-year prison sentence and a fine of €20 per day for 18 months, as well as disqualification from holding public office. The prosecutor does not find any mitigating or aggravating circumstances.
