Three-year prison sentence sought for assault during Carnival in southern Gran Canaria

The Public Prosecutor's Office has requested a three-year prison sentence for a man, identified as YEVG, accused of a violent assault that occurred during the Carnival celebrations in southern Gran Canaria in June 2022. The indictment, filed with the competent Criminal Court and to which Maspalomas24H has had access, charges the defendant with an alleged crime of assault after attacking his niece's ex-partner in a public place.

According to the Public Prosecutor's account, the events occurred at approximately 00:50 a.m. on June 5, 2022. The accused, a Spanish national with no prior criminal record, approached the victim, AJG, and allegedly gave her a hard shove that knocked her to the ground. Once on the ground, the accused allegedly continued the assault with several kicks to her back and attempted to punch her in the face, an impact that the woman managed to mitigate by putting up her right hand.

As a result of the attack, the woman suffered a displaced fracture of the fourth metacarpal bone in her right hand, as well as several lacerations in the lumbar region. The injuries required specialized medical treatment, including one day of hospitalization, immobilization with a splint, and a rehabilitation process. In total, the victim was unable to perform her daily activities for 136 days and suffers from lasting pain and disfigurement.

The prosecution classifies these acts as a crime of assault under Article 147.1 of the Spanish Penal Code, identifying the accused as the direct perpetrator. Since there are no mitigating or aggravating circumstances, the Public Prosecutor requests, in addition to a prison sentence, special disqualification from the right to passive suffrage and payment of court costs. Regarding civil liability, the provisional conclusions request that the accused compensate the victim with €14.162,63 for the injuries and physical consequences resulting from the assault. This amount must be adjusted in accordance with the provisions of the Civil Procedure Law after the commencement of the trial.
