The Public Prosecutor's Office has confirmed to Maspalomas24H that it has requested a trial and filed charges against a Cuban man, identified as DOD, for repeated sexual abuse of a minor in the municipality of Mogán, in southern Gran Canaria. The preliminary indictment, submitted to the Court of Instruction No. 3 of San Bartolomé de Tirajana, requests a five-year prison sentence for the accused, in addition to various disqualification measures and supervised release.
The indictment details that the events occurred continuously between 2011 and 2019, that is, from when the victim, MBMG, was only 4 or 5 years old until she turned 11. The accused, who frequently visited the girl's home to play with her son, took advantage of this proximity to commit inappropriate touching and sexual acts. The complaint was filed by the girl's father and legal guardian, MWMA, on December 7, 2022. As a result of this abuse, the victim's psychological evaluation reveals that she suffers from adjustment disorder with mixed anxiety and depressive mood.
The Public Prosecutor's Office considers the acts to constitute a continuing offense of sexual abuse of a minor under 16 years of age, as defined in the Penal Code in its wording in force at the time of the events. In addition to the five-year prison sentence, the following measures are requested for the accused: a four-year suspension, to be served after the prison sentence, which includes the obligation to report any change of residence or employment; a five-year ban on exercising parental authority, guardianship, curatorship, custody, or foster care; and a nine-year disqualification from any profession or occupation that involves regular and direct contact with minors.
Also, the prohibition of approaching the victim within 500 meters of her home or frequented place, and the prohibition of communicating with her by any means, both measures for a period of eight years.
